Same-Sex Marriage Legalization
Information from a Trusted Upland Divorce Attorney
On June 26, 2015, the U.S. Supreme Court ruled that our Constitution guarantees the right for all Americans to marry, including same-sex couples. President Obama called the decision a "victory for America" and it is already being hailed as a major civil rights victory of our country. Even in states that have already legalized same-sex marriage, like California, the ruling has a bearing on same-sex couples who have already married—especially if they are now facing a family law issue.

How Same-Sex Marriage has Changed in California
California legalized same-sex marriage in 2013, giving same-sex marriages all state-provided benefits. The Supreme Court decision, however, is a federal ruling and now gives married same-sex couples all over the country previously unavailable federal marriage benefits.
The new federal marriage benefits for same-sex couples include:
- Veteran and military benefits
- Federal employment benefits
- Social security spousal survivor benefits
- Social security retirement benefits
- Social security lump-sum death benefits
- Joint federal income tax filings
- Estate tax portability
While not all of these benefits now apply to every same-sex couple, many of them will and can potentially change the circumstances of a divorce, separation, or prenuptial agreement. The experienced attorney at Law Offices of Heidi H. Romeo, APLC is prepared to help couples facing these changes navigate their legal matter with a new and assured perspective. She can help her clients understand these new benefits and how they now color any existing or anticipated family law or divorce matter that they need to address.
